The Biden Administration tried to pull a fast one while no one was watching, but a level-headed federal judge, thank goodness, had the good sense to tell them “no way.”
They were trying to overturn Trump-era policy Title 42 which was instrumental in forcing over one-million illegal immigrants at the southern border to turn around and go home. The current administration is working diligently to allow them to come pouring back in. All of them. All at once. A stampede, if you will.
Title 42 is a health order related to the pandemic. For the first time ever, U.S. agents were given the authority to expel immigrants, no questions asked. No legal process was required.
Title 42 was set to expire this week and the Dems were trying their best to make sure nobody noticed. They didn’t succeed. The policy was extended and the judge more or less told them, “don’t even try,” as he slapped the lid shut on that can of worms.
It was an appointee of Donald Trump who made the final call. Louisiana U.S. District Judge Robert R. Summerhays slammed the gavel on the Dems by ruling that the restriction must remain in place, and he was kind enough to give the reason.
There’s a matter of a federal lawsuit being led by Louisiana, Arizona, and Missouri, with 21 other states marching behind, that needs to be resolved first. The lawsuit was filed in April, immediately following the CDC’s announcement to lift the health order.
The states in opposition to lifting the ban were successful in arguing that not renewing the policy would only serve to contribute to a “wave of illegal migration and drug trafficking.”
The White House disagrees with the ruling and is already slapping appeals together. Press secretary Karine Jean-Pierre said, “As the appeal proceeds, the Department of Homeland Security will continue planning for the eventual lifting of Title 42 in light of CDC’s public health judgment, at which point anyone who attempts to enter the country unlawfully will be subject to Title 8 Expedited Removal proceedings if they do not have grounds to remain in the United States.”
It may come as a surprise how many Democrat lawmakers heaved heavy sighs of relief at the outcome. They’ve got enough on their hands and Biden’s handling of the southern border crisis has done enough to damage their already in-the-dumper careers. Let it go for Christ’s sake.
These anti-Biden Democrats are smart enough to know that even if Title 48 had been overturned, there would have been no earthly way to handle the tsunami of immigrants crashing over the border. Plus, not setting politics aside, there’s a midterm to worry about.
Just because Title 42 has Donald Trump’s signature firmly affixed to it, the Biden administration wants to fix what isn’t broken and never has been. Even if they are one day successful at getting it overturned, it’ll only be re-instated in 2024 when they fall flat on their faces.
